Memorial insurance adjuster sued over windstorm claim

Insurance adjusters from Memorial and Fort Bend are being sued after a windstorm allegedly damaged a home in Cy-Fair.  

Cy-Fair residents Andy and Nong Graves filed a lawsuit on Sept. 16 in the Harris County District Court against Nationwide Lloyds, Memorial resident Magnolia Winkler and Fort Bend resident Tony Cole, citing unfair settlement practices, fraud, conspiracy to commit fraud, breach of contract and breach of duty.

The plaintiffs say that on June 8, 2010, a windstorm blew through Harris County, causing extensive damage to the roof of their home, located on Glenwood Park Drive in Cy-Fair. According to the brief, water leaked into the home from the damaged roof and ruined the home’s structure, ceiling, walls, insulation and flooring.

The suit alleges the plaintiffs’ insurance adjusters, Winkler and Cole, as well as Nationwide, undervalued and mishandled the Graves’ claim and wrongfully refused to cover their losses.

The Graves are seeking damages, attorney’s fees and court costs. They are being represented in the case by Houston attorney Theresa Lynn.
