Memorial-area Marriott blames Utah University for water damage

An insurer for the Marriott is suing over claims a guest's actions caused water damage at one of its hotels in Memorial.

Lexington Insurance, as subrogee of Memorial-area Houston Marriott Westchase, filed a lawsuit on Friday, June 1 in the Harris County District Court against Utah Valley University, citing breach of contract.

The plaintiffs say on Sept. 7, 2011, the Houston Marriot Westchase, located at 2900 Briarpark Drive in Memorial, sustained costly water damage when a hotel guest accidentally activated the sprinkler system by placing a clothing hanger on the head of a water sprinkler. Utah Valley University rented the guest's room because of a meeting scheduled at the hotel, according to the brief.

The plaintiffs are seeking attorney's fees, court costs and damages. They are being represented in the case by Houston attorney Loren Smith.
